### Terms of Service

#### User Obligations

By using "Amps," you agree to:

* Authenticate via your Farcaster account and allow Amps to take actions on your behalf, including liking, recasting, and posting.
* Ensure you complete engagement actions purchased by other users without reversal or fraud.

#### Fees and Payment Processing

"Amps" enables peer-to-peer payments between users via USDC. Windward Labs Inc. charges a 2.5% fee on each transaction. Funds may be temporarily held by Windward Labs Inc. during transaction processing to ensure successful completion.

#### Prohibited Activities

Users are strictly prohibited from:

* Engaging in fraudulent transactions, such as reversing or undoing engagements after payment.
* Harassing, abusing, or otherwise negatively impacting other users or the platform's operations.
* Using “Amps” to boost, amplify, or promote content that falls under restricted categories, including but not limited to:
  * Profanity, hate speech, or harassment.
  * Political content, election interference, or misinformation.
  * Financial solicitations, scams, or deceptive investment schemes.
  * Spam, phishing, or other deceptive engagement tactics.
  * Contract addresses or any blockchain transactions linked to illicit activity.
  * Nudity, sexual content, or explicit material.
  * Self-harm, violence, or threats of harm.
  * Extremist, terrorist, or criminal content.
  * Copyrighted material shared without authorization.

#### Enforcement and Consequences

Violation of these terms may result in:

* Immediate suspension or permanent banning from "Amps."
* No entitlement to refunds or dispute resolution through Windward Labs Inc.

#### Liability Disclaimer

Windward Labs Inc. provides "Amps" on an "as is" basis. We disclaim all liabilities related to the service quality, transaction disputes, user interactions, and financial losses. No refunds or dispute resolutions will be provided by Windward Labs Inc.

### Privacy Policy

#### Data Collection

Windward Labs Inc. collects and stores the following user data:

* Usernames
* Wallet addresses
* User-defined pricing information

This data is retained indefinitely unless deletion is requested by the user.

#### User Rights

Users have the right to:

* Delist their profiles at any time.
* Request complete deletion of personal data via email at <contact@brightmoments.io>.

#### Analytics and Third Parties

"Amps" utilizes Posthog for analytics to understand user interaction and improve platform functionality. Posthog processes data solely for analytical purposes.

We do not engage in third-party advertising or unrelated data sharing activities.
